Agreeing to these terms
These terms cover your use of the TempGuard Modesto Spray Foam Insulation website and any work you hire us to do. When you browse the site, send us the contact form, call for an estimate or schedule a job, you're agreeing to them, so please read them before you book.
If a written estimate or contract we give you for your house says something different from this page, the written estimate or contract controls for that job. If you don't agree with these terms, please don't use the site or book work through it.
What we do
We're an insulation contractor based in Modesto, CA, and we work in Modesto and the cities around it. Our work includes spray foam, blown-in and batt insulation, removing old insulation, air sealing, which means closing gaps before we insulate, and crawl space and vapor barrier work for homes and commercial buildings.
The home page lists our services, and you can read about our crew and how we work. Descriptions on the site are general. What we'll actually do at your house is set out in your written estimate.
Estimates and pricing
Estimates are free, on-site and carry no obligation. We look at your attic, walls or crawl space first because the price depends on what's up there, like how much old insulation you have, whether it has to come out, how much sealing the house needs, how easy it is to get to and which material you choose.
An estimate is our price for the work it describes, based on what we could see that day. Sometimes a job turns up something we couldn't see, such as insulation that's wet or full of droppings, damaged framing, or wiring that isn't safe to cover. When that happens, we stop, show you what we found and agree on the change and its price with you before we do the extra work.
An estimate is good for the period written on it. After that, material costs may have changed, and we may need to update the price before scheduling.
Scheduling, access and cancellation
We'll give you a start date once you accept the estimate. Weather, material deliveries and what we find once the job is open can move the date or the length of the job, and we'll tell you as soon as we know.
Please give our crew clear access to the work area, a path to it, and power and water where the job needs them. If we arrive and can't get in or do the work safely, we may have to reschedule.
Spray foam jobs come with a re-entry time, which is how long you, your kids and your pets need to stay out before coming back inside. We'll give you that time before the job, and you agree to follow it and our crew's other safety instructions.
If you need to cancel or move your appointment, call us as early as you can. If we've already ordered special materials or blocked out crew time for your job, we may charge you for those costs, as your estimate or contract explains.
Payment
Your written estimate or contract sets the price, any deposit and when payment is due. Unless it says otherwise, the balance is due when the work is done.
If a payment is late, we may pause unfinished work until it's caught up. You're responsible for reasonable collection costs on unpaid amounts, as far as California law allows.
Our workmanship and what we don't promise
We're licensed and insured, and we stand behind our work. If something about our workmanship isn't right, tell us and we'll come back to make it right.
Insulation materials carry their maker's warranty, and we'll pass those along to you. Your contract states anything more we cover in writing.
We can't promise a set drop in your power bill or a set temperature upstairs, because those depend on your house, your heating and cooling system, the weather and how you live in the house. We also don't warrant problems we didn't cause or work on, such as roof leaks, plumbing leaks, pests, existing mold or other contractors' work, or damage from misuse, later alterations or events outside our control.
Beyond what's written here and in your contract, we make no other warranties, express or implied, as far as the law allows.
Limits on our liability
As far as California law allows, TempGuard Modesto Spray Foam Insulation isn't liable for indirect, incidental or consequential losses, such as lost use of your home, higher energy costs or lost income, arising from the site or our work. Our total liability for any job is limited to what you paid us for that job.
Nothing on this page limits a right you have that the law doesn't allow us to limit.
Using this website
The articles, photos and descriptions on this site are general information about insulation, not advice for your specific house. Please call us or book an estimate before you make decisions about your home.
We work to keep the site accurate and up to date, but we don't promise it will always be complete, current or free of errors or interruptions. The site's text, photos and logo belong to us, so please don't copy them for commercial use without asking. Any links to outside sites are there for your convenience, and we aren't responsible for what those sites contain.
Settling a disagreement
If something goes wrong, call us first at (209) 222-5441. Most problems are settled with a conversation and a return visit, and we'd rather fix it than argue about it.
If we can't work it out together, either of us may take the matter to small claims court or another court in Stanislaus County, California, unless your contract sets out a different process.
California law applies
These terms and any work we do for you are governed by the laws of the State of California, without regard to its conflict of law rules.
Changes to these terms
We may update these terms from time to time, and the version posted on this page is the one in effect. Changes don't alter a contract you've already signed with us for a job.
If any part of these terms is found unenforceable, the rest still applies.
Questions about these terms
If anything here isn't clear, call us at (209) 222-5441, Monday through Sunday from 7 AM to 11 PM, or send us a note through our contact page. We respond within 1 business day.
